The webpage www.myran.gr (herein referred to as the “webpage” or “website”) engages with the promotion of furniture, lightingitems and houseware in general, through the internet. It has been created and operates by the company named “MYRAN PRIVATE COMPANY» (herein referred to as the “Company”), seated in Athens, Greece, 3 Fokylidou street, GR 10673, is legally represented, holds VAT No. 998411995, email: info@myran.gr and telephone no. +30 2103824744. A physical store is also located at the said address.

This e-shop enables all customers and all internet users to be kept updated on the products offered by the Company, the materials used, their characteristics, as well as to make their purchases online, either by directly selecting any of the products or by placing special orders customized to their preferences.

The following terms and conditions apply to the use of this website. Users accessing and trading or using the services provided hereunder (herein referred to as the “visitor(s)” or the “user(s)”), depending on whether they solely visit the company or supply their personal data for accessing the provided services, are deemed to consent and irrevocably accept the terms and conditions set forth below, without any exclusion. If a user does not agree with these terms, then they should – on their own responsibility – abstain from using this website, as well as from using any of the services provided thereunder.

The Company reserves the right to freely amend or review the terms and conditions on the use of and trading within the website, any time at its discretion, with Users being notified of any changes through the website.

Information

The Company is bound as to the accuracy, truth and fullness of the information presented at the website, regarding the Company’s identity and the information provided through the website in relation to the products. In the framework of good faith, the Company shall not be responsible and bound by entries of electronic data made by mistake or inadvertently according to common sense; the Company is entitled to correct such mistakes at any time the Company becomes aware of them.

Intellectual Property

All contents of this website, including the trade names, marks, images, graphic designs, photos, drawings, texts, etc. are intellectual property of the Company and they are protected under the applicable provisions of the Greek and EU law, as well as of international conventions and treaties. Furthermore, any third parties’ property, for which the Company has been exclusively authorized to use for its own needs and operation of its e-shop, is also protected. Any copy, transfer or creation of derivative of work based on this content or any customers’ misdirection in regard to the actual e-shop provider are strictly prohibited. Any reproduction, reissuance, uploading, notification, dissemination or transfer or any other use of the contents, by any means or medium for commercial purposes or otherwise shall be only allowed upon a prior written consent by the Company or any other copyright holder. All names, images, logos and distinctive marks presented at or describing the website and the products of the Company or any third parties’ products are deemed to be the intellectual property of the Company or of the third parties respectively and are protected under the applicable laws on trademarks. Their use by the website does by no means authorize or enable any third party to make use of them. 

Users’ Responsibility

Users agree and undertake to use the services, information and data of the website, as provided for by law and in compliance with the rules of good faith and trading practices. They may not use the e-shop for: 1) sending, publishing, emailing or by other means transferring any kind of illegal content, which illegally offends and harms the Company or any third party, or which jeopardizes the confidentiality of any person’s data, 2) sending, publishing, emailing or by other means transferring any content which opposes morality standards, social values, minorities, etc., 3) sending, publishing, emailing or by other means transferring any content which users are not entitled to transfer, as provided for by law or the applicable conventions/treaties (e.g. inside information, proprietary and other confidential information acquired or disclosed within the framework of business relations or which are protected under confidentiality agreements), 4) sending, publishing, emailing or by other means transferring of any content which violates any patent, trademark, commercial secret, copyright or other property rights of third parties, 5) sending, publishing, emailing or by other means transferring of any material containing malware or any other codes, files or programs designed to interrupt, harm, destruct or affect the operation of any computer software or hardware, 6) intentionally or unintentionally violating the applicable legislation or provisions, 7) annoying third parties in any manner or violating any third-party intellectual property rights, 8) collecting or storing personal data related to other users, 9) engaging in fraudulent activities.

Authorization

Under the terms and conditions hereof and all the applicable laws and regulations, this website vests a non-exclusive, non-transferrable, personal, and limited right to access use and present this website and the content thereof. This authorization does entail any ownership title transfer of the website and its content, and is subject to the following restrictions: 1. The user has to keep in all copies of the website and its content, all the footnotes related to copyright and other property rights, and 2. The user may by no means amend the website and its content or reproduce or publicly present or distribute by any other means or use the website and its content for any other public or commercial purpose, unless otherwise permitted hereunder.

Limitation of liability

The Company shall not be liable against any customer/user for any damage which may arise from the execution or non-execution of their order. In addition, the Company is without prejudice to the delivery time of the products in case of force majeure. The e-shop (www.myran.gr) may not guarantee product availability but the Company can guarantee that it shall promptly notify users in case of non-availability and that the users will be fully refunded if any payment has taken place. The e-shop uses its best efforts to provide top quality services; yet the Company cannot guarantee that there shall not be any website shut-down or “human” mistakes when updating/recording a price and/or the features of a product. So, if the user realizes that a product is sold at an irrationally low or high price comparing to its market value, the user is kindly requested, before placing their order, to contact the Company via email at info@myran.gr or telephone at +30 210 38 27 744.

Waiver

The website provides the content (e.g. information, names, photos, representations) and the products supplies through the same “as is”. It should be noted that a small deviation in colours may exist between the uploaded photos and the products exhibited by the Company. The Company shall under no circumstances have any civil or criminal liability for any damage (positive, special or consequential, which indicatively – and without limitation, alternatively and/or accumulatively entails the loss of income, data, earnings, compensation, etc.) which the visitor, user or a third party may suffer as a result of a cause related with the operation – or non-operation – and/or the use of the website and/or a failure to provide the services and/or the products and/or the information supplied thereby and/or as a result of unauthorized interventions by third parties to products and/or services and/or information offered through the website.

Product Care & Maintenance

Users are advised to follow the care instructions provided with each product to ensure longevity.

For natural materials (such as wood, marble, or fabric), variations in tone and texture are expected and proper care will maintain their quality over time.

Order placement & purchase of products

By visiting the e-shop, users may purchase the products offered by the Company. In this case, the provisions of Law no. 2251/1994 on distance contracts, as currently in force, after its recent harmonization with the European Directives 2019/771 and 2019/770 shall apply. Through the website and before completing their order, consumers are notified by the Company on the identity and the registered address of the supplier, the main features of the products, their price, quantity and shipping costs, the payment method, the delivery date and the validity term. As soon as the user places an order through the applicable form, they shall receive an electronic copy of their order at the email address indicated when placing the order. The email shall analytically set forth the ordered items and the online purchase is considered executed. In case the user does not receive the electronic copy of the order, the online purchase is not considered as executed. In such a case the user is advised to communicate with the Company via the e-shop

The user is fully responsible to check the confirmation email sent by the Company and to verify that their order has been placed correctly. All users should bear in mind that colours, sizes and finishes of the e-shop products are indicative. The Company shall not be responsible for the result reflected in the image/photo. Therefore, if the user is not sure about a product, they may contact the Company via the e-shop or visit the Company and ask to take a physical look on the available samples.

Some of the e-shop products are manufactured upon consumer’s order. The product features and the applicable materials are described in detail (color, origin, properties, use, etc.) at the website, below each offered product.

Furniture assembly is carried out by the customer.

Return of products / Return policy

The terms and conditions described herein apply to all products purchased in Greece and abroad through our e-shop at the Company’s website www.myran.gr.

Shipping costs for product returns shall be incurred exclusively by the user.

A return may be accepted only if the product the customer wants to return is at the exact same condition with the one when delivered and is accompanied by the related retail receipt or invoice and the packaging in perfect condition. The right to withdraw should be exercised within 14 days starting from the day of delivery. The relevant Form which must be completed and submitted to the Company is uploaded to the site of the e-shop and should be used by the user. A confirmation e-mail will be sent upon receipt of the relevant Form of Return The right to withdraw may not be exercised in case of a product’s manufacturing according to the consumer’s special specifications (made-to-order products) and generally in case of customized products.

If a product is returned during a sales period, the customer shall be refunded with the amount paid to purchase the product.

In case of clearance, exhibition products shall be sold at the condition under which they are exhibited at the store (e.g. flaws, marks, etc.) and they cannot be returned after purchase.

In case of faulty pricing, the user is kindly requested to contact the Company immediately. If the user has already placed an order, they may either purchase the product at its right price or cancel the order.

Although the right to withdraw within 14 days starting from the date of delivery does not presuppose any specific reason; in order to avoid any inconvenience during product delivery, the customer is strongly encouraged to check on the packaging for the courier’s possible maltreatments. In case of material failure or manufacturing mistake, products may be returned when such failure or mistake is verified by the manufacturer. Consumers must immediately notify the Company with regard to their intention to return a product, as soon as delivery has taken place (contact e-mail: info@myran.gr). Users are requested to proceed to the return within 5 working days upon delivery. In addition to the rights vested under the Company’s return policy, consumers in any case, have all the rights stipulated by the applicable laws and provisions on sale contracts, as well as any right arising in regard to the product guarantee terms, while the legislation on Consumer Protection i.e. Greek Law No 2251/1994, which in large part implements European Union rules into the Greek legal order, applies as it is in force.

Delivery

Products will be delivered within the time period mentioned upon receipt of the user’s order, at the place indicated by the user; however, in stock order are usually delivered within 3-5 business days – the above being confirmed by the Company after the receipt of the order If the user selects to collect the goods from the store, they are  relatedly being notified that the products are ready for delivery. Upon receipt of the above notification, the user should proceed to collect them within 10 days following the aforementioned notification. In case of delivery time extension attributable to the user, the products will be stored and the user shall be charged with extra cost. If the products are shipped the user is being notified and is obliged to sign upon receipt, the relevant documentation.

Delivery time is indicative and may be prolonged in case the user has not accurately provided the delivery particulars (e.g. telephone number, full name) for contacting them, in case of force majeure (strikes, adverse weather conditions, etc.) or third parties’ liability (for example, lack of raw material by our suppliers). In such case, the Company shall promptly contact the user in order to give the best viable solution. It should be noted that during summer months, especially during July and August, as well as during Christmas holidays, delivery times may be longer than the aforementioned period.

In the case that the user expresses no objection or reservation at the delivery time of the products, that means that the products fully comply with their preferences and that they unreservedly accept the same. However, the user’s right of fourteen (14) calendar days to withdraw from the distance contract or the contract outside a commercial store without stating the reasons and without any charge beyond those provided for in par. 2 of article 3i and article 3i of the Law 2251/1994 still remains, i.e. shipping costs; however, it is being clarified that the above right does not apply for distance and off-premise contracts when the supply of goods are manufactured to the user’s specifications or clearly personalized.

If the user exercises their right to withdraw timely, the Company shall return any payment they have received from the user, excluding shipping costs for the return which are borne by the user, upon receipt of the product. Refund will be carried out in the same method that the user used for the initial transaction. In case of online payments, the Company shall not be responsible for any delay due to third parties (e.g. your banking institute).

The user has to return the products to the Company without any unjustifiable delay, within 14 calendar days after the date they notify the Company on their decision to withdraw from the contract. The user will be charged with the direct cost of returning the products. Products to be returned, have to be into their initial packaging with all related documents attached.

If the returned product has suffered any damage or wear attributable to the customer or if its value has been impaired as a result of treatment which was unnecessary for defining the nature, the features and the functionality of the product, the Company shall assess the value of the damage and the extent of its value impairment. Thus, if the Company has to refund the customer, the related amount of the damage shall be deducted from the total refund amount.

This right may not be exercised for products manufactured under the consumer’s specifications or for profoundly customized products, i.e. the Company cannot refund or exchange made-to-order products, as it is stipulated by Law. Therefore, any orders related to products manufactured/ imported following a special or customized order may not be cancelled on any ground. If the customer wishes to change a feature of their initial order, this change has to be immediately notified before the production phase, so that the request and any financial issue arising from the addition/change to the initial order to be promptly settled; if the user does not notify the change before the production phase, the order cannot be changed. The user is kindly requested to ensure that the item and finish are right before ordering. Following delivery, made-to-order goods are non-returnable unless the Company has not supplied the correct item or specification as per the order confirmation.

Made-to-order goods include furniture and lighting items whereby you select a fabric, colour, material finish or size at the point of order.

The Company shall be responsible for any real defects and lack of agreed features of the products, according to articles 534 et. seq. of the Greek Civil Code. In these cases, the return cost shall be incurred by the Company.

Save for the above legal warranty, the Company provides no other commercial warranty or after-sales service for the products it sells.

Payment Method

When placing an order, the user should explicitly recognize that their order entails their obligation to pay. The Company enables the user to pay by five different methods: 1. Credit/Debit card, 2. PayPal, 3. Bank transfer (until receipt of the payment, products are not reserved for the user and if the Company does not receive the payment within ten (10) days from the submission of the request, the order is being cancelled, 4. Klarna 5. Cash on delivery, up to the amount of €150,00.

The product prices presented in our website are final and include VAT and any other applicable taxes. Extra charges apply for the delivery of the products to the user’s delivery address. The user shall be notified on such charges within the e-shop environment before completing their order/purchase. By placing a product into their basket, the user may find out the applicable shipping cost for your order.

In case the users choose to collect the products from the store, payment shall take place on the date that the products arrive at the store or at least within seven days. (when cash-on-delivery is chosen from the user). Otherwise, the user will be charged with extra storing costs. The user who has already paid and does not proceed to collect the products from the store within seven days starting from the date the products arrive at the store (the above being notified by the Company) will be also charged with extra storing costs.

In case of payment delay attributable to the user, the latter has to pay the legally applicable default interest.It should be noted that if the user requests the issuance of an invoice (‘timologio’) the sale agreement is considered as a B2B agreement and the General Terms and Conditions of the Company apply –  https://myran.gr/Terms.pdf

Wedding Lists & Gift Registry

Users can create a wedding registry by signing up for an account on the Company’s Website and visiting the Wedding List. The registry allows couples to curate a selection of products from our collection, which guests can purchase directly. Couples will receive notifications for each purchase made from their registry. Wedding list purchases are subject to standard return policies, except for custom or made-to-order items, which are non-refundable. Gift cards and store credit are valid for 12 months from the date of purchase and are non-refundable.

Trade Discounts & Bulk Orders

The Company offers special pricing for trade professionals, architects, and bulk orders. Customers interested in trade accounts should contact customer service.

International Orders & Import Duties

International customers are responsible for any customs duties and VAT charges upon delivery.

Security of transactions

The Company cooperates with ALPHA BANK for settling the transactions carried out through the e-shop via credit/debit cards, guaranteeing full security of the user’s transactions. By entering the user’s card particulars, the bank does not automatically charge the amount of their order but it freezes it. Their card is charged during the billing procedure. Their card particulars are transferred at a safe page operated by the Bank. ALPHA BANK uses SSL (Secure Socket Layer) 128bit encryption technology for certifying the security of their transactions. SSL is an international internet standard which offers 128bit encrypted communication. They may recognize an encrypted SSAL transaction by a small yellow lock at their browser and then they will be transferred to an https:// page. Through the SSL encryption, the computer sends a related request to the Bank server. The server reverts with the security certificate, the confirmation that they have visited a correct website and their public key. Next, their computer uses the public key for encrypting confidential information (e.g. your card number) and sends them to the server, which uses its own private key to have them decoded.

Τhe Company cooperates also with any other financial institution of its choice or payment service provider that it disclosed on its website which guarantee the safety of the transaction.

Resolution of disputes

Any dispute that may arise from the transactions between the Company and the users shall be settled by the courts of Athens, Greece.

Before raising legal proceedings, it is highly recommended to resort to an alternative/ extra-judicial settlement of disputes. The European Union has a platform for online settlement of disputes (ODR – Online Dispute Resolution). This platform may be used as a preliminary link for the extrajudicial settlement of disputes related to the contractual obligations arising from online purchase contracts and online service contracts. The Company is not involved in extrajudicial settlements before arbitration consumer bodies.

Miscellaneous

Force majeure: If for reasons attributed to force majeure (e.g. adverse weather conditions, strikes, etc.) it is impossible for the Company to deliver the products within the specified time, the user will be promptly notified via email, in order to clarify whether they want their order to be completed under the circumstances. The Company shall have no responsibility for any case that stands beyond its control and shall endeavour to serve the user best.

The Company reserves the right to amend or renew the offered products, the sale prices and other terms and conditions governing transactions. The Company is obliged to update this document regarding any change or addition.

The Company may at any time, at its absolute discretion, terminate an agreement made under these terms and conditions, by relatedly notifying the user and/or, in case the user maintains an account, by revoking their membership and disabling them from accessing their account. Furthermore, the Company may deprive the user from using its Services, without any prior notice, at any time and without having any liability towards the user.

Under these terms and conditions, the user accepts that any unauthorized use of the Company’s Services may lead to irreparable damage to the Company and/or its franchisors and partners, which probably cannot be fully remedied by any monetary compensation. As a result, in case of such an unauthorized use by the user, the Company and their franchisors/ partners (as the case may be), are entitled to request – in addition to any other available legal remedies – the enforcement of interim measures against the user, prohibiting them from making use of the Services provided through www.myran.gr.
